Motions
Use this reference for motions, petitions, rules to show cause, motions to compel, motions for temporary relief, enforcement motions, and other court requests.
Structure
A motion should lead with the relief requested, then give the legal basis, the short facts, the requested findings, and the proposed order language. Headings should be findings the court can adopt, not emotional labels or timeline captions.
Common shells
- Motion to compel: use when the user seeks production, disclosure, discovery responses, or compliance with an existing procedural duty.
- Motion for contempt or rule to show cause: use when an existing order was violated and the user wants enforcement after notice and hearing.
- Motion for temporary relief: use when the user needs interim custody, support, possession, fees, or conduct orders before final hearing.
- Motion to modify: use when there is an existing order and the user alleges a material change in circumstances.
Drafting checks
- Identify the exact order, statute, rule, or agreement being enforced.
- State precise relief in order-ready language.
- Put evidence references in exhibit form, not long inline quotations.
- Do not use contempt language unless the document is actually a contempt/enforcement filing.
- Include a separate proposed order when the court will need command language.
