Sworn Statements

Use this reference for declarations, affidavits, verifications, factual statements, and witness narratives.

Structure

Sworn statements are fact testimony, not argument. Use first-person personal knowledge, dated facts, and exhibit references. Do not use finding-style headings or advocacy verbs.

Common shells

  • Declaration: unsworn or penalty-of-perjury statement where allowed by rule or practice.
  • Affidavit: notarized sworn statement with jurat or notary block.
  • Verification: short sworn statement confirming a pleading or response.
  • Factual chronology: exhibit-backed factual record, usually not itself argument.

Drafting checks

  • One fact per numbered paragraph where possible.
  • Use dates, senders, recipients, exact amounts, and direct observations.
  • Avoid conclusions like bad faith, alienation, harassment, or contempt unless quoting a document or tied to a legal motion.
  • Facts that rely on documents cite exhibits.
  • End with the correct oath, jurat, or verification language.
